Vadra made gains from land licences: CAG -Ajay Sura

CHANDIGARH: Five companies, including Robert Vadra's Skylight Hospitality, bought licences to build colonies from the Haryana government for Rs 52.26 crore. They went on to sell these licences to other companies at a massive premium and collectively earned Rs 267.47 crore in a short span of time. But the profit of Rs 215.21 crore wasn't shared with the department of town and country planning despite bilateral agreements to split with the government any gain beyond 15%.

These details are contained in the Comptroller and Auditor General's (CAG) report on the Haryana government in 2012-13. The report was tabled in the state assembly on Wednesday, the last day of the budget session.

The report said the state government made huge losses given the manner in which the licences were sold. "Skylight Hospitality had sold its colony licence to DLF at 7.73 times the original cost after the in-principle approval of transfer of licence was granted in April 2012," the report said.

Former Haryana chief minister Bhupinder Hooda maintained that there was no lapse on the part of his government. "Everything had occurred in the framework and guidelines of the policy of the department and in accordance of law," he insisted.

Skylight purchased 3.5 acres in Gurgaon's Shikohpur village in 2008 for Rs 7.5 crore and, after obtaining a licence from the Congress government, sold the land to realty major DLF for around Rs 58 crore in April 2012. The issue was raised repeatedly by BJP and other parties just before the 2014 Lok Sabha elections.

The CAG report named four other companies which made profits in a similar fashion during the same period. These are Sun Star Builders Private Limited, Witness Construction Private Ltd and Botil Oil Tools India Private Limited. These companies sold the land at 303 times and 880 times the original cost to their collaborators within few months of getting the licence, the CAG report said.

It also mentioned that Uppal Housing Private Ltd sold the land to its subsidiary company Saumya Realtech Private Ltd for Rs 69.50 crore in March 2013. The report, however, did not state where these companies owned their lands.

CAG has recommended the Haryana government should make the procedure for granting colony licences more transparent so that only genuine developers get them and the state does not suffer revenue loss.

The CAG report went on to add that the Haryana exchequer made huge losses due to sale of licences by these companies and inaction of the department or town and country planning. It observed that the department failed to ensure that net profit beyond 15% of the total cost accrued to public exchequer as mandated by law.

"This enabled the developers to earn huge profit merely by selling the land, while the government had to forgo sizeable amount," observed CAG.
