Vedanta's alumina project in Odisha's Lanjigarh will be stuck for at least five more months, with the Supreme Court today referring the controversial issue of mining the nearby Niyamgiri hills back to the gram sabhas.

A bench, comprising justices Aftab Alam, K.S. Radhakrishnan and Ranjan Gogoi, said that the issue of tribal rights, especially their religious rights, had not been determined before grant of permission to mine the hills considered sacred by the local Kondhs.

The MOEF had withdrawn the environment and forest clearance to mine the hills citing the religious rights of the tribals under the newly enacted forest rights act.

The court said that the issue of tribal rights must be considered and settled by the gram sabhas. If the religious rights are recognised, they must be respected, the court said.

The gram sabhas will have three months to take a call on the issue and the MOEF another two months to decide on stage II clearance for mining.

The court order effectively stalls the alumina plant which has been unable to source alumina from elsewhere.
