Wakf lands: government, land allottees may move apex court by ML Melly Maitreyi

IT giants were allotted lands in Manikonda and surrounding areas since 2003

Though the High Court judgement directed the State Government to refer its dispute with the Wakf Board over the ownership of over 1,600 acres of land in Manikonda and surroundings to Wakf Tribunal for resolution, the government is confident that the outcome will not directly affect the legal allottees.

Several IT giants like Infosys, Wipro, Polaris and others like ISB, who were allotted lands in the area by successive governments since 2003 have developed institutions with massive investments. The High Court, in its order, said the nature and ownership of the land are to be adjudicated in the Wakf Tribunal.

While the Revenue Minister N. Raghuveera Reddy and senior officials maintain that they were yet to read the full judgement and understand the implications, indications are that the government as well as the 14 allottees may challenge the High Court's order in the Supreme Court.

Concerned over the development, the CEO of an IT company affected by the order, said the managements would take up the issue with Information Technology Minister Ponnala Lakshmaiah.

Ponnala's stand

On his part, Mr. Laxmaiah asserted that any ownership dispute or compensation issue was between the Government and Wakf Board. “These companies were allotted lands legally and backed by agreements and it is our responsibility to resolve the issue,” he said.

Minorities Welfare and Wakf Minister Mohd Ahmadullah said he welcomed the High Court's order as it went in favour of the State Wakf Board with regard to the lands of Dargah Hazarat Hussain Shah Wali at Manikonda Jagir village. The department would protect the Wakf properties across the State and implement the orders of the tribunal staying alienations, sale, mortgage of above Wakf land.

Role of Special Officer

MIM MLC Syed Altaf Hyder Razvi, a member of Wakf Board, who, along with another legislator Syed Aminul Hasan Jafri, raised the issue of sale transactions at Lanco Hills project in the Legislative Council, also welcomed the development. They said the lands were allotted when the Wakf Board was headed by a Special Officer. Subsequently, an elected Wakf Board filed a writ in October 2010 opposing the Special Officer's stand.

Wakf Board sources held the government mainly responsible for the current situation. They said MIM MLA Akbaruddin Owaisi had represented to the government repeatedly against allotting land without taking the Wakf Board into confidence.

Meanwhile, Lanco Hill Tech Park CEO Venkatram Reddy said that they would approach the Supreme Court against the Wakf Tribunal's order in 2011 not to alienate the land. Lanco purchased the land in public auction as the highest bidder and was allowed by the High Court to take up construction. It had also taken all the necessary approvals and followed due diligence in land use.
