West Bengal government files caveat in SC over Singur land law

West Bengal government on Monday filed a caveat in Supreme Court so that no petition by Tata Motors Ltd (TML) over the Singur land issue is heard on ex-parte basis.

The move was made subsequent to TML counsel Samaraditya Pal's efforts to (a) first get an exparte ad-interim stay on land distribution at Singur which was turned down by Justice Soumitra Pal (b) then appeal to a division bench of the court for the same, which Justice Pratap Kumar Ray and Justice Md Abdul Ghani rejected since it was an oral appeal, following which Pal left the court. On his way out, he told newsmen: "I am going to Nagpur and then to Delhi".

All this gave the impression that Pal, desperate now to get a stay on the land distribution proceedings at Singur, would be heading for the Supreme Court. State government lawyers acted swiftly on this cue, filing the caveat in Supreme Court around 4.15 pm. The government counsel Kalyan Bandopadhyay said: "The caveat was filed to ensure that the state was heard, if TML moved any petition on Singur land." While the attention may now shift to Supreme Court, the original writ petition filed by TML challenging the Singur Land Rehabilitation and Development Act will continue to be heard at Calcutta High Court.

The TML counsel's apprehension was that the state government will start distributing land to farmers from Tuesday. Pal in fact said: "Not only have forms been printed, but they have been distributed as well and thousands have already been submitted. The land may also start getting distributed from tomorrow. Unless immediate interim protection is given, the challenge will become infructous."

At Singur, the district administration is moving ahead at blazing speed. On Monday, 886 unwilling farmers submitted their application forms to the administration.

Nearly 50 officials from the state land and land reforms department are now camping at Singur to earmark the plots, which will be returned to the farmers.

The district magistrate of Hooghly, Sreepriya Rangarajan also visited the site today, to supervise the process of land return.
