                            <div align="justify">-The Times of India</div><p align="justify"><br /><em>NEW DELHI: </em>The Supreme Court on Wednesday said it would ensure smooth panchayat polls in West Bengal after the State Election Commission rushed with a petition accusing the Mamata Banerjee government of playing truant in providing adequate security forces for a free and fair voting process.</p><p align="justify">&quot;We will ensure smooth conduct of panchayat elections in West Bengal,&quot; the Supreme Court said on Wednesday, displaying steely resolve to defuse the acrimonious situation created by the tussle between SEC and state government.</p><p align="justify">This assurance from a bench of Justices A K Patnaik and Ranjan Gogoi came in response to the West Bengal State Election Commission's desperate stand that it might be forced to postpone the three-phase panchayat polls scheduled from July 2 because of persistent non-cooperation from the Mamata Banerjee government to put adequate security forces at the commission's disposal.</p><p align="justify">The bench issued notices to the state's chief secretary, panchayat and rural development secretary and the Union government and asked them to respond within two days to the SEC's plea for adequate forces to ensure free and fair polls.</p><p align="justify">Justices Patnaik and Gogoi directed the state government and the Centre to apprise it on June 28 &quot;how they proposed to meet the requirement of forces mentioned in the May 14 order of the Calcutta High Court as well as in the communication addressed by the SEC to the state on May 22 and June 14&quot;.</p><p align="justify">SEC's counsel Meenakshi Arora said though the Calcutta HC was dealing with the matter and attempting to resolve it, persistent refusal of the state government to provide adequate forces had tied the hands of the commission, which is constitutionally mandated to conduct and supervise polls.</p><p align="justify">&quot;Repeated requests for providing adequate forces were ignored. Nearly 6,000 panchayat seats have gone uncontested. This is a serious issue as 6,000 seats accounted for 10% of the total seats going for polls,&quot; she said.</p><p align="justify">The SEC had asked for 2,41,000 security personnel -- 1,45,000 armed and 96,000 unarmed - to conduct polls but the state said it would provide only 55,000. The SEC had agreed before the Calcutta HC for a multi-phase election to tide over the paucity of security forces.</p><p align="justify">&quot;Even the number of security personnel required for deployment, as determined by the HC, is not being provided for,&quot; Arora said. The SEC said if adequate forces were not provided, the commission would be forced to postpone the elections.</p><p align="justify">Arora further accused the government of asking government employees, who had been put on duty as election observers, to defy the commission's orders.</p><p align="justify">Senior advocate Amarendra Saran, appearing for the Bengal government, accused the SEC of playing ducks and drakes by agreeing with the state before the HC on deployment of forces and then rushing to the Supreme Court with an imaginary problem. He said the state was ready to provide adequate forces.</p><p align="justify">When Saran accused the SEC of not being serious in holding the elections, the bench asked, &quot;You (the state government) want the elections or not?&quot; Saran said the TMC government wanted to hold elections and requested the apex court to allow the HC, which is hearing the matter, to resolve the issue.</p><p align="justify">The Supreme Court said it would not decide the issue. Justices Patnaik and Gogoi said, &quot;We will ensure that the elections take place as scheduled and are conducted smoothly. Leave it to us to decide which matters we should entrust to the high court and which we ourselves should deal with. If you (the state) want elections to be held, let us handle it.</p><p align="justify">&quot;If you don't want to hold elections, it is a separate matter. We have a lot more information about what is happening in West Bengal and in the high court. The hearing in the high court is going on and on. But nothing has happened till date. If you want elections, take notice and respond to the Election Commission's petition.&quot;</p><p align="justify">As of now, the polls are slated to be held in three phases -- July 2, 6 and 9 -- and counting is scheduled for July 13.</p><p align="justify">The tussle between the SEC and the Mamata Banerjee government started when the latter suo-motu on March 22 announced two-phase panchayat polls in the state in the last week of April relying on Section 42 of West Bengal Panchayat Elections Act.</p><p align="justify">The SEC moved the HC challenging the state government's power to hold elections in the face of constitutional mandate to the Election Commission to conduct and supervise polls. The HC ruled in favour of the SEC but the Trinamool government had been citing lack of forces for election duty.</p>

                            <div align="justify">-The Times of India</div><p align="justify"><br /><em>NEW DELHI: </em>The Supreme Court on Wednesday said it would ensure smooth panchayat polls in West Bengal after the State Election Commission rushed with a petition accusing the Mamata Banerjee government of playing truant in providing adequate security forces for a free and fair voting process.</p><p align="justify">&quot;We will ensure smooth conduct of panchayat elections in West Bengal,&quot; the Supreme Court said on Wednesday, displaying steely resolve to defuse the acrimonious situation created by the tussle between SEC and state government.</p><p align="justify">This assurance from a bench of Justices A K Patnaik and Ranjan Gogoi came in response to the West Bengal State Election Commission's desperate stand that it might be forced to postpone the three-phase panchayat polls scheduled from July 2 because of persistent non-cooperation from the Mamata Banerjee government to put adequate security forces at the commission's disposal.</p><p align="justify">The bench issued notices to the state's chief secretary, panchayat and rural development secretary and the Union government and asked them to respond within two days to the SEC's plea for adequate forces to ensure free and fair polls.</p><p align="justify">Justices Patnaik and Gogoi directed the state government and the Centre to apprise it on June 28 &quot;how they proposed to meet the requirement of forces mentioned in the May 14 order of the Calcutta High Court as well as in the communication addressed by the SEC to the state on May 22 and June 14&quot;.</p><p align="justify">SEC's counsel Meenakshi Arora said though the Calcutta HC was dealing with the matter and attempting to resolve it, persistent refusal of the state government to provide adequate forces had tied the hands of the commission, which is constitutionally mandated to conduct and supervise polls.</p><p align="justify">&quot;Repeated requests for providing adequate forces were ignored. Nearly 6,000 panchayat seats have gone uncontested. This is a serious issue as 6,000 seats accounted for 10% of the total seats going for polls,&quot; she said.</p><p align="justify">The SEC had asked for 2,41,000 security personnel -- 1,45,000 armed and 96,000 unarmed - to conduct polls but the state said it would provide only 55,000. The SEC had agreed before the Calcutta HC for a multi-phase election to tide over the paucity of security forces.</p><p align="justify">&quot;Even the number of security personnel required for deployment, as determined by the HC, is not being provided for,&quot; Arora said. The SEC said if adequate forces were not provided, the commission would be forced to postpone the elections.</p><p align="justify">Arora further accused the government of asking government employees, who had been put on duty as election observers, to defy the commission's orders.</p><p align="justify">Senior advocate Amarendra Saran, appearing for the Bengal government, accused the SEC of playing ducks and drakes by agreeing with the state before the HC on deployment of forces and then rushing to the Supreme Court with an imaginary problem. He said the state was ready to provide adequate forces.</p><p align="justify">When Saran accused the SEC of not being serious in holding the elections, the bench asked, &quot;You (the state government) want the elections or not?&quot; Saran said the TMC government wanted to hold elections and requested the apex court to allow the HC, which is hearing the matter, to resolve the issue.</p><p align="justify">The Supreme Court said it would not decide the issue. Justices Patnaik and Gogoi said, &quot;We will ensure that the elections take place as scheduled and are conducted smoothly. Leave it to us to decide which matters we should entrust to the high court and which we ourselves should deal with. If you (the state) want elections to be held, let us handle it.</p><p align="justify">&quot;If you don't want to hold elections, it is a separate matter. We have a lot more information about what is happening in West Bengal and in the high court. The hearing in the high court is going on and on. But nothing has happened till date. If you want elections, take notice and respond to the Election Commission's petition.&quot;</p><p align="justify">As of now, the polls are slated to be held in three phases -- July 2, 6 and 9 -- and counting is scheduled for July 13.</p><p align="justify">The tussle between the SEC and the Mamata Banerjee government started when the latter suo-motu on March 22 announced two-phase panchayat polls in the state in the last week of April relying on Section 42 of West Bengal Panchayat Elections Act.</p><p align="justify">The SEC moved the HC challenging the state government's power to hold elections in the face of constitutional mandate to the Election Commission to conduct and supervise polls. The HC ruled in favour of the SEC but the Trinamool government had been citing lack of forces for election duty.</p>

                            <div align="justify">-The Times of India</div><p align="justify"><br /><em>NEW DELHI: </em>The Supreme Court on Wednesday said it would ensure smooth panchayat polls in West Bengal after the State Election Commission rushed with a petition accusing the Mamata Banerjee government of playing truant in providing adequate security forces for a free and fair voting process.</p><p align="justify">&quot;We will ensure smooth conduct of panchayat elections in West Bengal,&quot; the Supreme Court said on Wednesday, displaying steely resolve to defuse the acrimonious situation created by the tussle between SEC and state government.</p><p align="justify">This assurance from a bench of Justices A K Patnaik and Ranjan Gogoi came in response to the West Bengal State Election Commission's desperate stand that it might be forced to postpone the three-phase panchayat polls scheduled from July 2 because of persistent non-cooperation from the Mamata Banerjee government to put adequate security forces at the commission's disposal.</p><p align="justify">The bench issued notices to the state's chief secretary, panchayat and rural development secretary and the Union government and asked them to respond within two days to the SEC's plea for adequate forces to ensure free and fair polls.</p><p align="justify">Justices Patnaik and Gogoi directed the state government and the Centre to apprise it on June 28 &quot;how they proposed to meet the requirement of forces mentioned in the May 14 order of the Calcutta High Court as well as in the communication addressed by the SEC to the state on May 22 and June 14&quot;.</p><p align="justify">SEC's counsel Meenakshi Arora said though the Calcutta HC was dealing with the matter and attempting to resolve it, persistent refusal of the state government to provide adequate forces had tied the hands of the commission, which is constitutionally mandated to conduct and supervise polls.</p><p align="justify">&quot;Repeated requests for providing adequate forces were ignored. Nearly 6,000 panchayat seats have gone uncontested. This is a serious issue as 6,000 seats accounted for 10% of the total seats going for polls,&quot; she said.</p><p align="justify">The SEC had asked for 2,41,000 security personnel -- 1,45,000 armed and 96,000 unarmed - to conduct polls but the state said it would provide only 55,000. The SEC had agreed before the Calcutta HC for a multi-phase election to tide over the paucity of security forces.</p><p align="justify">&quot;Even the number of security personnel required for deployment, as determined by the HC, is not being provided for,&quot; Arora said. The SEC said if adequate forces were not provided, the commission would be forced to postpone the elections.</p><p align="justify">Arora further accused the government of asking government employees, who had been put on duty as election observers, to defy the commission's orders.</p><p align="justify">Senior advocate Amarendra Saran, appearing for the Bengal government, accused the SEC of playing ducks and drakes by agreeing with the state before the HC on deployment of forces and then rushing to the Supreme Court with an imaginary problem. He said the state was ready to provide adequate forces.</p><p align="justify">When Saran accused the SEC of not being serious in holding the elections, the bench asked, &quot;You (the state government) want the elections or not?&quot; Saran said the TMC government wanted to hold elections and requested the apex court to allow the HC, which is hearing the matter, to resolve the issue.</p><p align="justify">The Supreme Court said it would not decide the issue. Justices Patnaik and Gogoi said, &quot;We will ensure that the elections take place as scheduled and are conducted smoothly. Leave it to us to decide which matters we should entrust to the high court and which we ourselves should deal with. If you (the state) want elections to be held, let us handle it.</p><p align="justify">&quot;If you don't want to hold elections, it is a separate matter. We have a lot more information about what is happening in West Bengal and in the high court. The hearing in the high court is going on and on. But nothing has happened till date. If you want elections, take notice and respond to the Election Commission's petition.&quot;</p><p align="justify">As of now, the polls are slated to be held in three phases -- July 2, 6 and 9 -- and counting is scheduled for July 13.</p><p align="justify">The tussle between the SEC and the Mamata Banerjee government started when the latter suo-motu on March 22 announced two-phase panchayat polls in the state in the last week of April relying on Section 42 of West Bengal Panchayat Elections Act.</p><p align="justify">The SEC moved the HC challenging the state government's power to hold elections in the face of constitutional mandate to the Election Commission to conduct and supervise polls. The HC ruled in favour of the SEC but the Trinamool government had been citing lack of forces for election duty.</p>

-The Times of India NEW DELHI: The Supreme Court on Wednesday said it would ensure smooth panchayat polls in West Bengal after the State Election Commission rushed with a petition accusing the Mamata Banerjee government of playing truant in providing adequate security forces for a free and fair voting process. "We will ensure smooth conduct of panchayat elections in West Bengal," the Supreme Court said on Wednesday, displaying steely resolve to defuse the acrimonious situation created by the tussle between SEC and state government. This assurance from a bench of Justices A K Patnaik and Ranjan Gogoi came in response to the West Bengal State Election Commission's desperate stand that it might be forced to postpone the three-phase panchayat polls scheduled from July 2 because of persistent non-cooperation from the Mamata Banerjee government to put adequate security forces at the commission's disposal. The bench issued notices to the state's chief secretary, panchayat and rural development secretary and the Union government and asked them to respond within two days to the SEC's plea for adequate forces to ensure free and fair polls. Justices Patnaik and Gogoi directed the state government and the Centre to apprise it on June 28 "how they proposed to meet the requirement of forces mentioned in the May 14 order of the Calcutta High Court as well as in the communication addressed by the SEC to the state on May 22 and June 14". SEC's counsel Meenakshi Arora said though the Calcutta HC was dealing with the matter and attempting to resolve it, persistent refusal of the state government to provide adequate forces had tied the hands of the commission, which is constitutionally mandated to conduct and supervise polls. "Repeated requests for providing adequate forces were ignored. Nearly 6,000 panchayat seats have gone uncontested. This is a serious issue as 6,000 seats accounted for 10% of the total seats going for polls," she said. The SEC had asked for 2,41,000 security personnel -- 1,45,000 armed and 96,000 unarmed - to conduct polls but the state said it would provide only 55,000. The SEC had agreed before the Calcutta HC for a multi-phase election to tide over the paucity of security forces. "Even the number of security personnel required for deployment, as determined by the HC, is not being provided for," Arora said. The SEC said if adequate forces were not provided, the commission would be forced to postpone the elections. Arora further accused the government of asking government employees, who had been put on duty as election observers, to defy the commission's orders. Senior advocate Amarendra Saran, appearing for the Bengal government, accused the SEC of playing ducks and drakes by agreeing with the state before the HC on deployment of forces and then rushing to the Supreme Court with an imaginary problem. He said the state was ready to provide adequate forces. When Saran accused the SEC of not being serious in holding the elections, the bench asked, "You (the state government) want the elections or not?" Saran said the TMC government wanted to hold elections and requested the apex court to allow the HC, which is hearing the matter, to resolve the issue. The Supreme Court said it would not decide the issue. Justices Patnaik and Gogoi said, "We will ensure that the elections take place as scheduled and are conducted smoothly. Leave it to us to decide which matters we should entrust to the high court and which we ourselves should deal with. If you (the state) want elections to be held, let us handle it. "If you don't want to hold elections, it is a separate matter. We have a lot more information about what is happening in West Bengal and in the high court. The hearing in the high court is going on and on. But nothing has happened till date. If you want elections, take notice and respond to the Election Commission's petition." As of now, the polls are slated to be held in three phases -- July 2, 6 and 9 -- and counting is scheduled for July 13. The tussle between the SEC and the Mamata Banerjee government started when the latter suo-motu on March 22 announced two-phase panchayat polls in the state in the last week of April relying on Section 42 of West Bengal Panchayat Elections Act. The SEC moved the HC challenging the state government's power to hold elections in the face of constitutional mandate to the Election Commission to conduct and supervise polls. The HC ruled in favour of the SEC but the Trinamool government had been citing lack of forces for election duty.
