The Goa state information commission(GSIC) recently directed the accounts department to provide salary details of a government employee to his estranged wife. The government employee had filed a divorce plea in court.

The wife had sought the details under the Right To Information Act (RTI) so as to claim maintenance but the government employee had urged the accounts department not to furnish his salary details.

Having considered at least five rulings of the central information commission (CIC) in such cases, the Goa state information commission noted: "If one balances RTI Act and individual's right to privacy, the citizen's right to information would naturally get greater weightage. It is held by various rulings of CIC that disclosure of information such as assets of a public servant, which is routinely collected by the public authority and routinely provided by public servants, cannot be construed as an invasion on the privacy of an individual."

The government employee has filed a matrimonial suit against his wife seeking dissolution of his marriage by a decree of divorce. The wife is contesting the divorce and has filed an application for interim maintenance saying that she is unemployed and hence dependant on her sister.

She stated that her husband was earning about Rs 25,000 per month which was enhanced after the 6th pay commission was implemented in Goa. She also said he was running businesses in other person's names.

The court wanted the exact amount of her husband's salary to decide the quantum of maintenance and directed her to place on record a copy of her husband's revised salary certificate. She had filed her RTI application asking for details of her husband's salary in January 2011. The accounts department denied her the information saying the details pertained to a third party (husband) and that the third party had asked that the details be not furnished. Her appeal to the first appellate authority was also rejected and she then appealed to the Goa state information commission.
