Centre denies green nod to Lavasa

Lavasa, touted as India's first planned hill city, suffered a setback on Friday. The Union environment and forests ministry refused to grant Lavasa, being built near Pune, a green clearance till the Maharashtra government takes action against the project for its existing violations.

The company cannot continue construction work till it gets the clearance. The ministry's order is bound to delay the project for a while, if not put entirely put it in jeopardy.

"As the pre-condition on the credible action on violation of EIA Notification, 2006, has not been complied with, the ministry is unable to issue the environmental clearance to the first phase of Hill City project (2000 ha) of M/s LCL," the ministry said in its order.

The ministry said a final decision would not be taken till the Bombay High Court takes a call on the ongoing case and the Maharashtra government acts against the project developers for flouting green laws.

Lavasa can only hope for a favourable order from the HC or own up to the violations, which would empower the state government to take immediate action, and also demolish the case in court.

The ministry had contended that the promoters of the hill city had begun construction without taking the mandatory clearance. Lavasa argued before the ministry and the HC that it was legally not required to take the clearance, and hence it did not violate the Environment Protection Act, 1986.

Even as the case was going on in the HC for existing violations, the ministry entertained Lavasa for a new clearance for the project's first phase.

The ministry put five pre-conditions as norms to consider the clearance proposal for the first phase, covering 2000 hectares. Initially, Lavasa accepted all the pre-conditions, but later contested one clause that stated the state government should take action against it for violations.
