Cobrapost sting: Staff at ICICI Bank, HDFC Bank and Axis Bank may have violated KYC norms, says RBI

MUMBAI: The employees at ICICI Bank, HDFC Bank and Axis Bank may have violated know-your-customer norms and helped clients evade taxes, the Reserve Bank of India's investigation has found. "Banks opened current account based on power of attorney without KYC," ET Now reported citing people familiar with the report.

"Banks gave cash advances for gold purchases", which is a violation of norms, it said. The central bank and the banks themselves began independent investigations after cobrapost.com, an online news provider, captured on camera suggestions by bank officials that they could help clients avoid tax, convert black money into accounted money, and even siphon off funds.

Banks exonerated themselves after an internal investigation into the sting operation showed there was no compromise on knowyour-client norms since no transaction had taken place.

The banks now face regulatory penalty for lax internal governance standards. Selling of unsuitable products by bank employees to clients has become a menace with thousands of clients complaining that bankers are misleading them. Regulators across the globe are tightening standards and even the RBI has faced similar issues in the past.

Regulating the incentives for bank staff down the line and independent scrutiny to sell insurance policies are among measures regulators contemplate to prevent recurrence of money laundering and tax evasion charges, said three people familiar with the thinking. The insurance regulator may evolve its own know-yourcustomer guidelines for sale of insurance policies, which, some believe, is the weakest link in the financial services sector. The three banks suspended nearly 40 employees caught on camera. ICICI Bank and HDFC Bank appointed auditors Deloitte Touche Tohmatsu to conduct a full, independent forensic inquiry into the reported events.

Financial Services Secretary Rajiv Takru is likely to meet RBI officials on Thursday to decide the future course of action with regard to the allegation of money laundering by staff of ICICI Bank, HDFC Bank and Axis Bank.
