Companies named by CAG set to face CBI heat by Shalini Singh

After Raja, Behura and Chandolia, the heat's now on the new 2G licencees which have benefited from the telecom scam. Fear stalks the telecom industry that the CBI may now zero in on promoters and senior executives of some companies.

The CBI FIR of October 2009 says, "Certain officials of DoT entered into a criminal conspiracy with certain private persons/companies and misused their official position in grant of Unified Access Service License, causing wrongful loss to the government and causing corresponding wrongful gain to those private persons/companies".

Targets are companies that that have been listed in the CAG report for receiving licences in January 2008. These include Swan (now Etisalat DB), Unitech, Tata Tele, Sistema Shyam, S Tel, Datacom (now Videocon), Loop, Idea and Allianz Infratel.

When contacted, a CBI official said, "Investigations are on, we cannot divulge the details". It is speculated that the agency has already registered preliminary enquiries against some of the companies even though FIRs have not been lodged yet.

Many of these companies are already facing the heat of show cause notices issued recently by the DoT for failure to comply with rollout obligations and on account of the fact that they were found "ineligible" for receiving licenses by the CAG.

Apart from show cause notices, if criminal conspiracy is established, then in addition to the losses to the exchequer tabulated by the CAG, a corresponding gain to the private persons/companies will become an automatic corollary of the loss. The corresponding gain can only have been made by those persons/companies, including lobbyists and middlemen, that benefited from Raja's actions.

The arrests add weight to the CAG report although telecom minister Kapil Sibal has sought to make light of it. Raja's defence has been weakened by Sibal's announcement last week that all future spectrum can be allocated through transparent auctions. Raja had said he could not opt for auctions since he was following the TRAI.

The SC has set February 11 for the CBI to present its progress report on the enhancement of the scope of its investigation, which includes the CAG report, issues related to dual technology, and grant of licenses since 2008.
