Delhi high court pulls up babus over water bodies -Abhinav Garg & Neha Lalchandani

NEW DELHI: Unhappy with failure of state authorities to preserve and protect the fast diminishing water bodies in the capital, the Delhi high court has issued contempt notice to the environment secretary and the DDA vice-chairman.

Justice G S Sistani recently sought a response from the state government and DDA's top officials why they should not be charged with contempt of court for being unable to effectively curb encroachments on water bodies despite express instructions from the court in 2003 and 2005.

HC has now given time till August 7 to the officers to file their reply. It was hearing a contempt petition by environment activist Vinod Kumar Jain who informed the court he filed a petition in 2000 on the protection and revival of the water bodies in Delhi. During the course of hearings the state government had admitted to the existence of 629 water bodies in 2006 which could be traced from the revenue records.

The number of water bodies in Delhi is around 900 but no change has been made to the 2006 government list. The progress on revival and restoration has also been woefully slow and in these past years, several water bodies, including those mentioned in the 2006 records, have been encroached upon or even allotted by the various land owning agencies for development work.

"The court appointed committee has been making regular visits to water bodies but are meeting stiff resistance from the land owning agency who refuse to co-operate. Initially they started by concretizing the water bodies but that work was stopped after the court's intervention. If work continues at this space, no water body will be left for the government to preserve," said sources.
