Despite court order, Noida farmers yet to get reviewed damages by Purusharth Aradhak

They may not be in news like their counterparts in Bhatta-Parsaul, but the fight of farmers in Noida against the satellite city Authorityand the UP government is nothing new. It's been on since 1976 when land was acquired for the first time to lay the foundation stone of Noida.

And this fight hasn't been completely futile. On July 30, 2010, Allahabad high court directed the Noida Authority to pay reviewed land compensation at the rate of Rs 28.12 per square yard.

But the order has not been implemented so far. OnSeptember 28, 2010,Noida Authority secretary Shrish Chand Verma wrote to the additional district magistrate (land acquisition), asking him to submit the calculation sheet of those farmers whose cases have been pending since 1976. A similar letter was sent again on April 21, 2011. TOI has a copy of the second letter.

Verma said no compensation could be released without the calculation sheet which has to be filled up by the ADM. "We have written twice to the ADM (LA) to submit the calculation sheet. I have also personally told him to do so." Verma, however, claimed the delay did not amount to "contempt of court".

District magistrate Deepak Aggarwal said, "The ADM (LA) works under the jurisdiction of the Noida Authority. I am, on my part, will order the ADM to settle the case as soon as possible."

The high court verdict followed a ruling of a district court in Ghaziabad on February 26, 1986, which asked the Authority to pay the Noida farmers at Rs 9.92 per square yard.

The affected farmers alleged that the authorities wrapped up the work of private builders within a week while it had been only empty assurances for them for the last 36 years. "The Authority seems less bothered about the farmers who have been cheated since the foundation of Noida. Only empty assurances have been given. We have met almost all senior officials of the Noida Authority. Unfortunately, the Authority does not listen to the farmers without any agitation or mishap," fumed Virender of Raghunath Pura, whose land was acquired in 1976 and it became part of the Noida stadium.

"Most villagers are still living on their landand the Authority has registered encroachment cases against them. Few years ago, slums developed in sectors 6, 8, 9 and other areas. The Authority has planned to launch a scheme to offer them flats and the farmers who are still living on their land are facing legal action," said Kiranpal Sharma, another farmer.

The Authority has not even fulfilled its own commitments to the Noida villagers. "My land was acquired in 1976. At that time, the Authority promised to offer a plot under the rehabilitation scheme. I am still fighting for it. In 2006, the Noida Authority launched a scheme and I applied. A draw was conducted and in 2009 I paid Rs 7 lakh for a plot of 162 square metres. But the Authority cancelled the allotment in 2011 saying I have encroached upon its land as I am still living in my old house," said Ombir of Harola village.

Bhim Chand of Atta village has a similar tale to tell. His land was acquired and he had deposited Rs 10.68 lakh after a plot of 250 square metres was allotted to him, but it was cancelled on the similar ground. In both cases, the Authority did not bother to carry out any check before allotting the plots.
