Government calls all-party meet to relook on Land Acquisition Act

Most state governments have sought a relook at UPA's Land Acquisition Rehabilitation and Resettlement Act, 2013, pushing the Centre into convening an all-party meet, probably as early as the next fortnight.

A consensus at the meeting of all parties heading state governments will let the Centre amend the law in the current monsoon session itself.

This revision of the land law is imperative for the Centre to execute major infrastructure projects through the public-private partnership route as envisaged in Arun Jaitley's budget.

Land acquisition has come up as the single biggest hurdle for most of the new mega industrial projects.

The Samajwadi Party government of Uttar Pradesh, AIADMK's in Tamil Nadu, Trinamool Congress' in West Bengal and BJD's in Odisha, accounting for most of the non-BJP, non-Congress state governments and a chunk of votes in the Rajya Sabha where BJP is in a minority, are keen on getting the Act amended for various reasons.

Many states want complete autonomy on issues of land acquisition, keeping the Centre at arm's length.

For instance, West Bengal has categorically sought to have its own land acquisition policy. Tamil Nadu wants the "power to define public purpose" and feels the present act is an "infringement upon the state's autonomy." UP too has sought similar powers for the state government. Odisha, though has refrained from making political demands, is expected to go along with the Centre on getting the Act amended.

Rural development minister Nitin Gadkari had organised a conference of revenue ministers of all state governments on June 27 and ET had reported on July 7 the possibility of government tweaking the Land Act to speed up key projects.

The consensus that emerged at the conference of the revenue ministers of the state governments is that, "consent clause should be removed from PPP projects, the definition of affected family needs to be re-examined, autonomy for state governments, social impact assessment only for large projects, retrospective clause for compensation should be modified, penalty provisions against civil servants are too stringent, return of unutilised land to original owners to be deleted" and a few other instances of radical departure from UPA's show piece legislation that was deemed as anti-industry.

Interestingly, Congress-ruled states such as Kerala slammed the central Act, while conclusively seeking state specific Acts on land acquisition. "Obtaining consent of land owners prior to preliminary notification is a herculean task as the identification of land owners at such initial stages may pose a problem," said the Kerala government's representative. Haryana wanted the consent requirement to be done away with. While Karnataka insisted, "social impact study should be compulsory only for large projects."
