NEW DELHI: What actions constitute rape? If you are a rape survivor what happens during medical exam? Is the two finger test legal? What information should your FIR on sexual assault contain? Can you afford to delay it? Can you ask for medical assistance but refuse to file a case? Fundamental questions like these are rarely raised by anyone except victims of sexual violence and the answers are known mostly only to legal experts. But given the rising instances of sexual violence, it has become imperative that these facts be known to every woman.

Two handbooks for survivors of sexual violence discussing such issues that relate to the legal system were released on Monday by Chief Justice of India P Sathasivam. The guides -- Locating the Survivors in the Criminal Justice System: Decoding the Law and Engaging the Criminal Justice System: A Guide to Survivors of Violenc -- have been put together by the Lawyers Collective Women's Rights Initiative. The CJI has asked all high courts, subordinate courts, Legal Services Authority and the Judicial Commission to translate the two publications in regional languages and ensure their distribution.

Indira Jaising, Additional Solicitor General and the director of the initiative, said at the launch of the handbooks that it is not enough to just have laws against sexual violence; an entire ecosystem too needs to be created to back them. Creating this ecosystem, too, is the responsibility of the judiciary, she said. "This will ensure that people come forward and use the law," she said on the need for the two publications.

Justice Sathasivam expressed his dismay at the declining rate of conviction in cases relating to sexual violence. He said the entire system from the police to the legal fraternity needs to rally around the survivor. He said the judiciary had to play a critical role in dealing with the problem of sexual violence, using creative and progressive solutions. He pointed out, for instance, that rape victims in India often choose to turn to their family for counsel before filing a case and this delay in filing an FIR should not be held against them.
