Haryana lifts ceiling on non-farm land by Dipak Kumar Dash

The Haryana assembly on Wednesday removed the limit on land ownership by a person or entity in case of non-agricultural land in urban and industrial zones. This comes after a recent Punjab and Haryana high court observation on "grave violations" of land ceiling laws by real estate companies, several of which own hundreds of acres of land.

The assembly passed the Ceiling on Land Holdings (Amendment) Bill, 2011, which is likely to bring greater transparency into land holdings. Sources said that earlier, private developers and even industrial units used to buy small patches of lands in different names, if only to comply with the norms of the earlier act.

The maximum land holding ranged between 7.5 hectares and 18 hectares. The new law will be applicable on all cases of non-agricultural land ownerships after 1975.

Only a fortnight ago, the revenue department of Haryana issued an ordinance on these lines to remove uncertainty and mitigate the negative effects on infrastructural projects set up in the state owing to issues arising out of the ceiling laws on urban and industrial land. "All the development , including the housing and industrial projects in cities like Gurgaon and Faridabad , have come up on patches of land that were technically agricultural. Our land ceiling laws were formulated when the state was an agrarian society. But things have changed and the law had to be amended," said Haryana's revenue secretary Raj Kumar.

He admitted that the issue came into focus after the recent observation of the high court. "There are a few industries in Gurgaon and other parts of Haryana, which have come up on over 100 acres of land. Continuing with the old norms could have posed a threat to all such development," Kumar said. This amendment will come as a big relief to private developers who had been setting up several nonoperative firms to buy patches of land. "Earlier, people used to obtain huge patches of land by violating the law. But now it will be more transparent," said Naveen Raheja, who heads the real estate cell of Assocham.
