<div align="justify">-The Economic Times<br /><br />A high-level panel set up after last month's gang-rape case in Delhi may have made headlines for not recommending the death penalty for rapists, but it is triggering concerns across India Inc for advocating far-reaching changes in rules that govern sexual harassment in corporate workplaces.<br />The panel headed by former Supreme Court chief justice JSVerma, in its report submitted to the government, has said employers must not attempt conciliation proceedings in cases of complaints about sexual harassment, and that firms be made liable if they have permitted the creation of a workplace environment where acts of sexual harassment have become systemic.<br /><br />The panel said the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Bill, which covers all government and private employers in the country and was passed by Lok Sabha last September and now awaits Rajya Sabha clearance, did not "adequately reflect" the spirit of a 1997 Supreme Court judgement that defined sexual harassment at workplaces and framed guidelines to deal with it.<br /><br />The 631-page report submitted on Wednesday was closely scrutinised for its comments on the death penalty, sought by many for the six accused in the Delhi case, but a closer examination of its contents is throwing up potential problem areas for the corporate sector too.<br /><br />The committee, in a significant recommendation, has said instead of companies setting up their own internal committees to investigate sexual harassment complaints, an Employment Tribunal must be set up in every state comprising two retired judges, two sociologists and a social activist to investigate all such complaints. This tribunal, it said, could review company premises to assess steps taken to prevent sexual harassment.<br /><br />The panel specifically sought the removal of the three-month time limit for making a complaint after an incident of sexual harassment, as specified in the government's bill. It has also suggested that no action should be taken against a woman even if her complaint is ultimately found to be false, while urging for compensation to be paid by the company if found to be true.<br /><br />Some of these suggestions have triggered concerns across India Inc. "Some recommendations are good and some are preposterous," said Santrupt Misra, director, global HR & CEO, Carbon Black Business at the Aditya Birla Group.<br /><br />Misra said the recommendation barring employers from attempting conciliation between the suspect and a woman complainant was correct, but the suggestion that companies will be liable for purportedly permitting the creation of a workplace environment where sexual harassment is rampant could create a new set of problems.<br /><br />"No company deliberately does it and how do you define it. The suggestion that no action should be taken against a woman in the event of her complaint being false is very surprising. False accusations should be punished. Also, companies can deal with the matter internally and setting up of tribunal may not work," Misra said.<br /><br />A Mahendran, MD of Godrej Consumer Products, said it was wrong to spare people from punishment even when they are found to have made false charges. "If an allegation is proven to be false, whatever the legal course, should be taken. Nobody could be left without punishment, male or female, in case of false charges."<br /><br />The committee, whose other members include former Himachal Pradesh chief justice Leila Seth and former solicitor-general Gopal Subramaniam, specifically objected to Section 10(1) of the proposed bill, which allows for conciliation in case of a request from the complainant, saying conciliation could be used as an effective tool to muzzle the proposed tribunal's primary duty to investigate sexual harassment cases.<br /><br />"Complainant shall not be permitted to withdraw a complaint... We apprehend that permitting either mandatory conciliation, even if at the instance of the complainant, or permitting her to withdraw her complaint will negatively impact the ability of women to bring valid complaints before the tribunal," the report said, adding that "myriad pressurising influences" are brought to bear upon women in our society.<br /><br />SY Siddiqui, chief operating officer in charge of administration (HR, finance, IT & COSL) at Maruti Suzuki India said complaint redressal mechanisms within companies were a better option than external tribunals.<br /><br />"The current system...will be much faster and practical. If every corporate can create a deterrent such things will not happen. Making it far away (by setting up external Employment Tribunal) may not be realistic. Instead, providing mechanism within corporate will give ease of implementation," he said.<br /><br /><br />The committee, meanwhile, sought a particular portion in the proposed legislation — Section 14, which provides for action in cases of false or malicious complaints of sexual harassment — to be deleted.<br /><br />"Where an aggrieved woman makes a complaint, it is possible that she will be faced with opposition from the employer as well. In such cases, it is often possible that evidence may be manipulated by the employer or those acting in concert with the employer so as to ostensibly falsify the allegations against the aggrieved woman. The fear is that such a provision would promote a culture among employers with means to render false a genuine complaint," the report said. Instead, it suggested that the tribunal may just reprimand a false complaint, which will be "punishment enough" as it will have far-reaching consequences on her future employment prospects.<br /><br />Justice Verma has asked Prime Minister Manmohan Singh to speedily implementation the recommendations of the report. "It is the committee's hope that the promptitude with which this committee was constituted within a few days of the brutal gang-rape in Delhi on December 16, 2012, will continue to accomplish the task by speedy implementation of its recommendations to retain public confidence in good governance," he said in a letter to the prime minister on Wednesday.<br /><br />The home ministry has said it is studying the report and will forward it to a parliamentary standing committee for consideration. Legal experts have praised the report and its recommendations, noting that it was well thought out and expansive in its scope.<br /><br />"It is a well-considered report which plugs several loopholes and covers lacunae in the law by creating new offences like stalking, inappropriate touching etc. It locates the offence of rape in the larger context of sexual harassment generally... It wisely refrains from succumbing to popular pressure, which was expected from a commission of this stature. It avoids recommending death penalty as also punishments like chemical castration, which are as inhuman as many other punishments which we consider medieval," said noted lawyer Raju Ramachandran.</div>

<div align="justify">-The Economic Times<br /><br />A high-level panel set up after last month's gang-rape case in Delhi may have made headlines for not recommending the death penalty for rapists, but it is triggering concerns across India Inc for advocating far-reaching changes in rules that govern sexual harassment in corporate workplaces.<br />The panel headed by former Supreme Court chief justice JSVerma, in its report submitted to the government, has said employers must not attempt conciliation proceedings in cases of complaints about sexual harassment, and that firms be made liable if they have permitted the creation of a workplace environment where acts of sexual harassment have become systemic.<br /><br />The panel said the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Bill, which covers all government and private employers in the country and was passed by Lok Sabha last September and now awaits Rajya Sabha clearance, did not "adequately reflect" the spirit of a 1997 Supreme Court judgement that defined sexual harassment at workplaces and framed guidelines to deal with it.<br /><br />The 631-page report submitted on Wednesday was closely scrutinised for its comments on the death penalty, sought by many for the six accused in the Delhi case, but a closer examination of its contents is throwing up potential problem areas for the corporate sector too.<br /><br />The committee, in a significant recommendation, has said instead of companies setting up their own internal committees to investigate sexual harassment complaints, an Employment Tribunal must be set up in every state comprising two retired judges, two sociologists and a social activist to investigate all such complaints. This tribunal, it said, could review company premises to assess steps taken to prevent sexual harassment.<br /><br />The panel specifically sought the removal of the three-month time limit for making a complaint after an incident of sexual harassment, as specified in the government's bill. It has also suggested that no action should be taken against a woman even if her complaint is ultimately found to be false, while urging for compensation to be paid by the company if found to be true.<br /><br />Some of these suggestions have triggered concerns across India Inc. "Some recommendations are good and some are preposterous," said Santrupt Misra, director, global HR & CEO, Carbon Black Business at the Aditya Birla Group.<br /><br />Misra said the recommendation barring employers from attempting conciliation between the suspect and a woman complainant was correct, but the suggestion that companies will be liable for purportedly permitting the creation of a workplace environment where sexual harassment is rampant could create a new set of problems.<br /><br />"No company deliberately does it and how do you define it. The suggestion that no action should be taken against a woman in the event of her complaint being false is very surprising. False accusations should be punished. Also, companies can deal with the matter internally and setting up of tribunal may not work," Misra said.<br /><br />A Mahendran, MD of Godrej Consumer Products, said it was wrong to spare people from punishment even when they are found to have made false charges. "If an allegation is proven to be false, whatever the legal course, should be taken. Nobody could be left without punishment, male or female, in case of false charges."<br /><br />The committee, whose other members include former Himachal Pradesh chief justice Leila Seth and former solicitor-general Gopal Subramaniam, specifically objected to Section 10(1) of the proposed bill, which allows for conciliation in case of a request from the complainant, saying conciliation could be used as an effective tool to muzzle the proposed tribunal's primary duty to investigate sexual harassment cases.<br /><br />"Complainant shall not be permitted to withdraw a complaint... We apprehend that permitting either mandatory conciliation, even if at the instance of the complainant, or permitting her to withdraw her complaint will negatively impact the ability of women to bring valid complaints before the tribunal," the report said, adding that "myriad pressurising influences" are brought to bear upon women in our society.<br /><br />SY Siddiqui, chief operating officer in charge of administration (HR, finance, IT & COSL) at Maruti Suzuki India said complaint redressal mechanisms within companies were a better option than external tribunals.<br /><br />"The current system...will be much faster and practical. If every corporate can create a deterrent such things will not happen. Making it far away (by setting up external Employment Tribunal) may not be realistic. Instead, providing mechanism within corporate will give ease of implementation," he said.<br /><br /><br />The committee, meanwhile, sought a particular portion in the proposed legislation — Section 14, which provides for action in cases of false or malicious complaints of sexual harassment — to be deleted.<br /><br />"Where an aggrieved woman makes a complaint, it is possible that she will be faced with opposition from the employer as well. In such cases, it is often possible that evidence may be manipulated by the employer or those acting in concert with the employer so as to ostensibly falsify the allegations against the aggrieved woman. The fear is that such a provision would promote a culture among employers with means to render false a genuine complaint," the report said. Instead, it suggested that the tribunal may just reprimand a false complaint, which will be "punishment enough" as it will have far-reaching consequences on her future employment prospects.<br /><br />Justice Verma has asked Prime Minister Manmohan Singh to speedily implementation the recommendations of the report. "It is the committee's hope that the promptitude with which this committee was constituted within a few days of the brutal gang-rape in Delhi on December 16, 2012, will continue to accomplish the task by speedy implementation of its recommendations to retain public confidence in good governance," he said in a letter to the prime minister on Wednesday.<br /><br />The home ministry has said it is studying the report and will forward it to a parliamentary standing committee for consideration. Legal experts have praised the report and its recommendations, noting that it was well thought out and expansive in its scope.<br /><br />"It is a well-considered report which plugs several loopholes and covers lacunae in the law by creating new offences like stalking, inappropriate touching etc. It locates the offence of rape in the larger context of sexual harassment generally... It wisely refrains from succumbing to popular pressure, which was expected from a commission of this stature. It avoids recommending death penalty as also punishments like chemical castration, which are as inhuman as many other punishments which we consider medieval," said noted lawyer Raju Ramachandran.</div>

<div align="justify">-The Economic Times<br /><br />A high-level panel set up after last month's gang-rape case in Delhi may have made headlines for not recommending the death penalty for rapists, but it is triggering concerns across India Inc for advocating far-reaching changes in rules that govern sexual harassment in corporate workplaces.<br />The panel headed by former Supreme Court chief justice JSVerma, in its report submitted to the government, has said employers must not attempt conciliation proceedings in cases of complaints about sexual harassment, and that firms be made liable if they have permitted the creation of a workplace environment where acts of sexual harassment have become systemic.<br /><br />The panel said the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Bill, which covers all government and private employers in the country and was passed by Lok Sabha last September and now awaits Rajya Sabha clearance, did not "adequately reflect" the spirit of a 1997 Supreme Court judgement that defined sexual harassment at workplaces and framed guidelines to deal with it.<br /><br />The 631-page report submitted on Wednesday was closely scrutinised for its comments on the death penalty, sought by many for the six accused in the Delhi case, but a closer examination of its contents is throwing up potential problem areas for the corporate sector too.<br /><br />The committee, in a significant recommendation, has said instead of companies setting up their own internal committees to investigate sexual harassment complaints, an Employment Tribunal must be set up in every state comprising two retired judges, two sociologists and a social activist to investigate all such complaints. This tribunal, it said, could review company premises to assess steps taken to prevent sexual harassment.<br /><br />The panel specifically sought the removal of the three-month time limit for making a complaint after an incident of sexual harassment, as specified in the government's bill. It has also suggested that no action should be taken against a woman even if her complaint is ultimately found to be false, while urging for compensation to be paid by the company if found to be true.<br /><br />Some of these suggestions have triggered concerns across India Inc. "Some recommendations are good and some are preposterous," said Santrupt Misra, director, global HR & CEO, Carbon Black Business at the Aditya Birla Group.<br /><br />Misra said the recommendation barring employers from attempting conciliation between the suspect and a woman complainant was correct, but the suggestion that companies will be liable for purportedly permitting the creation of a workplace environment where sexual harassment is rampant could create a new set of problems.<br /><br />"No company deliberately does it and how do you define it. The suggestion that no action should be taken against a woman in the event of her complaint being false is very surprising. False accusations should be punished. Also, companies can deal with the matter internally and setting up of tribunal may not work," Misra said.<br /><br />A Mahendran, MD of Godrej Consumer Products, said it was wrong to spare people from punishment even when they are found to have made false charges. "If an allegation is proven to be false, whatever the legal course, should be taken. Nobody could be left without punishment, male or female, in case of false charges."<br /><br />The committee, whose other members include former Himachal Pradesh chief justice Leila Seth and former solicitor-general Gopal Subramaniam, specifically objected to Section 10(1) of the proposed bill, which allows for conciliation in case of a request from the complainant, saying conciliation could be used as an effective tool to muzzle the proposed tribunal's primary duty to investigate sexual harassment cases.<br /><br />"Complainant shall not be permitted to withdraw a complaint... We apprehend that permitting either mandatory conciliation, even if at the instance of the complainant, or permitting her to withdraw her complaint will negatively impact the ability of women to bring valid complaints before the tribunal," the report said, adding that "myriad pressurising influences" are brought to bear upon women in our society.<br /><br />SY Siddiqui, chief operating officer in charge of administration (HR, finance, IT & COSL) at Maruti Suzuki India said complaint redressal mechanisms within companies were a better option than external tribunals.<br /><br />"The current system...will be much faster and practical. If every corporate can create a deterrent such things will not happen. Making it far away (by setting up external Employment Tribunal) may not be realistic. Instead, providing mechanism within corporate will give ease of implementation," he said.<br /><br /><br />The committee, meanwhile, sought a particular portion in the proposed legislation — Section 14, which provides for action in cases of false or malicious complaints of sexual harassment — to be deleted.<br /><br />"Where an aggrieved woman makes a complaint, it is possible that she will be faced with opposition from the employer as well. In such cases, it is often possible that evidence may be manipulated by the employer or those acting in concert with the employer so as to ostensibly falsify the allegations against the aggrieved woman. The fear is that such a provision would promote a culture among employers with means to render false a genuine complaint," the report said. Instead, it suggested that the tribunal may just reprimand a false complaint, which will be "punishment enough" as it will have far-reaching consequences on her future employment prospects.<br /><br />Justice Verma has asked Prime Minister Manmohan Singh to speedily implementation the recommendations of the report. "It is the committee's hope that the promptitude with which this committee was constituted within a few days of the brutal gang-rape in Delhi on December 16, 2012, will continue to accomplish the task by speedy implementation of its recommendations to retain public confidence in good governance," he said in a letter to the prime minister on Wednesday.<br /><br />The home ministry has said it is studying the report and will forward it to a parliamentary standing committee for consideration. Legal experts have praised the report and its recommendations, noting that it was well thought out and expansive in its scope.<br /><br />"It is a well-considered report which plugs several loopholes and covers lacunae in the law by creating new offences like stalking, inappropriate touching etc. It locates the offence of rape in the larger context of sexual harassment generally... It wisely refrains from succumbing to popular pressure, which was expected from a commission of this stature. It avoids recommending death penalty as also punishments like chemical castration, which are as inhuman as many other punishments which we consider medieval," said noted lawyer Raju Ramachandran.</div>

A high-level panel set up after last month's gang-rape case in Delhi may have made headlines for not recommending the death penalty for rapists, but it is triggering concerns across India Inc for advocating far-reaching changes in rules that govern sexual harassment in corporate workplaces. The panel headed by former Supreme Court chief justice JSVerma, in its report submitted to the government, has said employers must not attempt conciliation proceedings in cases of complaints about sexual harassment, and that firms be made liable if they have permitted the creation of a workplace environment where acts of sexual harassment have become systemic.
The panel said the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Bill, which covers all government and private employers in the country and was passed by Lok Sabha last September and now awaits Rajya Sabha clearance, did not "adequately reflect" the spirit of a 1997 Supreme Court judgement that defined sexual harassment at workplaces and framed guidelines to deal with it.
The 631-page report submitted on Wednesday was closely scrutinised for its comments on the death penalty, sought by many for the six accused in the Delhi case, but a closer examination of its contents is throwing up potential problem areas for the corporate sector too.
The committee, in a significant recommendation, has said instead of companies setting up their own internal committees to investigate sexual harassment complaints, an Employment Tribunal must be set up in every state comprising two retired judges, two sociologists and a social activist to investigate all such complaints. This tribunal, it said, could review company premises to assess steps taken to prevent sexual harassment.
The panel specifically sought the removal of the three-month time limit for making a complaint after an incident of sexual harassment, as specified in the government's bill. It has also suggested that no action should be taken against a woman even if her complaint is ultimately found to be false, while urging for compensation to be paid by the company if found to be true.
Some of these suggestions have triggered concerns across India Inc. "Some recommendations are good and some are preposterous," said Santrupt Misra, director, global HR & CEO, Carbon Black Business at the Aditya Birla Group.
Misra said the recommendation barring employers from attempting conciliation between the suspect and a woman complainant was correct, but the suggestion that companies will be liable for purportedly permitting the creation of a workplace environment where sexual harassment is rampant could create a new set of problems.
"No company deliberately does it and how do you define it. The suggestion that no action should be taken against a woman in the event of her complaint being false is very surprising. False accusations should be punished. Also, companies can deal with the matter internally and setting up of tribunal may not work," Misra said.
A Mahendran, MD of Godrej Consumer Products, said it was wrong to spare people from punishment even when they are found to have made false charges. "If an allegation is proven to be false, whatever the legal course, should be taken. Nobody could be left without punishment, male or female, in case of false charges."
The committee, whose other members include former Himachal Pradesh chief justice Leila Seth and former solicitor-general Gopal Subramaniam, specifically objected to Section 10(1) of the proposed bill, which allows for conciliation in case of a request from the complainant, saying conciliation could be used as an effective tool to muzzle the proposed tribunal's primary duty to investigate sexual harassment cases.
"Complainant shall not be permitted to withdraw a complaint... We apprehend that permitting either mandatory conciliation, even if at the instance of the complainant, or permitting her to withdraw her complaint will negatively impact the ability of women to bring valid complaints before the tribunal," the report said, adding that "myriad pressurising influences" are brought to bear upon women in our society.
SY Siddiqui, chief operating officer in charge of administration (HR, finance, IT & COSL) at Maruti Suzuki India said complaint redressal mechanisms within companies were a better option than external tribunals.
"The current system...will be much faster and practical. If every corporate can create a deterrent such things will not happen. Making it far away (by setting up external Employment Tribunal) may not be realistic. Instead, providing mechanism within corporate will give ease of implementation," he said.
The committee, meanwhile, sought a particular portion in the proposed legislation — Section 14, which provides for action in cases of false or malicious complaints of sexual harassment — to be deleted.
"Where an aggrieved woman makes a complaint, it is possible that she will be faced with opposition from the employer as well. In such cases, it is often possible that evidence may be manipulated by the employer or those acting in concert with the employer so as to ostensibly falsify the allegations against the aggrieved woman. The fear is that such a provision would promote a culture among employers with means to render false a genuine complaint," the report said. Instead, it suggested that the tribunal may just reprimand a false complaint, which will be "punishment enough" as it will have far-reaching consequences on her future employment prospects.
Justice Verma has asked Prime Minister Manmohan Singh to speedily implementation the recommendations of the report. "It is the committee's hope that the promptitude with which this committee was constituted within a few days of the brutal gang-rape in Delhi on December 16, 2012, will continue to accomplish the task by speedy implementation of its recommendations to retain public confidence in good governance," he said in a letter to the prime minister on Wednesday.
The home ministry has said it is studying the report and will forward it to a parliamentary standing committee for consideration. Legal experts have praised the report and its recommendations, noting that it was well thought out and expansive in its scope.
"It is a well-considered report which plugs several loopholes and covers lacunae in the law by creating new offences like stalking, inappropriate touching etc. It locates the offence of rape in the larger context of sexual harassment generally... It wisely refrains from succumbing to popular pressure, which was expected from a commission of this stature. It avoids recommending death penalty as also punishments like chemical castration, which are as inhuman as many other punishments which we consider medieval," said noted lawyer Raju Ramachandran.
