Interim stay on cancellation of Greenpeace’s registration

In a breather to Greenpeace India Society, the Madras High Court on Wednesday granted an interim stay on a Home Ministry order, which cancelled the Foreign Contributions (Regulations) Act, 2010 registration given to the international NGO.

When the plea filed by Greenpeace came up for hearing on Wednesday, which challenged the Home Ministry order on September 2, Justice M.M. Sundresh granted an interim stay on the order and ordered for issuing of notice returnable in four weeks.

The plea filed by Greenpeace India’s Executive Director Vinuta Gopal referred to three earlier instances when the Centre had passed adverse orders, which were eventually ordered against by various courts and further claimed the Home Ministry has taken recourse to the “draconian and thoroughly unconstitutional” provisions of the FCRA, 2010.

Observing that a suspension of registration under the Act cannot extend beyond 180 days, as per certain provisions of the FCRA, the plea contended that the Ministry “being unable to justify its suspension order, and fearing another adverse judicial finding, issued the impugned order just one day before the matter was scheduled for final hearing, and just prior to the expiry of the 180 day period.”

After suspending its licence to receive foreign donations, the Ministry had on September 2 cancelled the registration of Greenpeace citing various reasons.
