Land Acquisition Bill gets a green signal from Rajya Sabha

Rajya Sabha on Wednesday passed the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Bill, 2013. The proposed law, which will replace the Land Acquisition Act, 1894 that suffers from various shortcomings, including silence on the issue of resettlement and rehabilitation of those displaced, stipulates mandatory consent of at least 70 per cent of landowners for acquiring land for Public Private Partnership (PPP) projects and 80 per cent for acquiring land for private firms.

There were 142 members present in the House during vote, of which 131 voted in favour of the Bill. There was one abstention.

The Bill, which was passed in Lok Sabha on August 29, was passed in Rajya Sabha after the government agreed to some last-minute amendments pushed by Madhya Pradesh Chief Minister Shivraj Singh Chouhan.

Earlier, the introduction of the Bill was delayed by over two hours due to logjam following persistent sloganeering by JD(U) MPs and counter-protests by BJP MPs over the allegations levelled by suspended IPS officer D G Vanzara, arrested in fake encounter cases, against Gujarat Chief Minister Narendra Modi. The House was adjourned several times during which Congress floor managers discussed with opposition leaders to break the logjam.

The House could take up the Bill only after an impromptu discussion on the missing coal blocks allocation files issue as part of a compromise between the government and the BJP to end the stand-off that resulted from the Prime Minister leaving immediately after making a statement on the issue Tuesday.

Finally, Rural Development Minister Jairam Ramesh moved the Bill for consideration and passage around 4.30 pm.

Initiating the debate, BJP MP Vinay Katiyar, while expressing concern over many clauses of the proposed law, stressed the need to ensure that farmers have the right to appeal against the compensation awarded in lieu of land acquired.

Shantaram Naik (Cong), while dubbing the proposed law a historic one, said adequate compensation would now be given to farmers both in rural and urban areas while special authorities would be set up to decide on land acquisition cases.

Supporting the Bill, BSP chief Mayawati, however, asserted that it had been prepared "half-heartedly" keeping Lok Sabha elections in mind.

Derek O'Brien (TMC) said his party would vote against the legislation as they are in favour of complete acquisition of land by industry instead of the government having any role in the same.

Ram Gopal Yadav (SP), whose party supported the Bill, said several amendments were required in the proposed law as there was an apprehension that farmers would not be adequately compensated.

Supporting the Bill, Sitaram Yechury (CPM) demanded that it should have a provision to ensure that previous land owners should have a say in the appreciated value of the land at later stages noting that most often this is the cause of heartburn that original land owners are denied a share in the increased land value. He asked the government to assure the House that special powers of urgency for land acquisition as envisaged in the Bill will never be invoked for the sake of private owners. Yechury also demanded removal of Schedule IV of the Bill saying this was of particular concern and sought more clarity on the definition of public purpose for acquiring land.
