Land acquisition: HC raises doubt on ‘kind’ of farmers

A Public Interest Litigation (PIL) filed by a bunch of farmers against acquisition of their agricultural land and the government’s food security policy triggered intriguing remarks from the Delhi High Court, which wanted to know what “kind” of farmers they were.

The petition was filed by the farmers against acquisition of their land in Kanjhawala. The petitioners contended that the move was against the government’s food security policy. The petition also sought a white paper on the issue from the Centre.

But a Division Bench of acting Chief Justice Madan B Lokur and Justice Mukta Gupta wanted to know for certain the motive behind the PIL. “Do you have photos of the houses of these farmers?” Justice Lokur asked the petitioners’ counsel. “We want to know what kind of farmers they are because we know there are different kinds of farmers in Delhi: there are farmers who own big houses and are not involved in farming at all. If they come to us and claim they are worried about food security, we will not entertain their pleas.”

The counsel replied that the court should not be concerned about affluence of the farmers as the petition tried to raise the more important issue of food security, and the government’s wrongful acquisition of their land.

“But we are concerned with this,” the Bench observed. “Please show us the pictures of their houses to let us know whether these are luxury litigations (cases filed by litigants to stall the judicial process) or they (litigants) are genuinely concerned about the problems.”

The court also told the counsel that it knew of “farmers” in Chhattarpur area of the Capital who own plush farmhouses and are not into farming. “You must pick up the right farmers for rightful adjudication of the issue,” Justice Lokur told the counsel.

Government counsel Najmi Waziri submitted that the land was acquired in 1985 as per rules and the farmers cannot be allowed to raise grievances now.
