Lokpal consensus being stitched: Extent of control over CBI remains sticky point by

The extent of control that Lokpal should have over CBI remained a sticky point at the all party meeting here on Wednesday. NDA representatives at the meeting insisted on the investigative independence of the CBI and its complete disassociation from government.

The all-party meeting was essentially aimed at hearing out the views of various political parties on the anti-graft body. BJP, Left and BSP insisted that the Bill should be brought in the current session of Parliament.

However, finance minister Pranab Mukherjee in his concluding remarks said the government had heard all the views and will bring a bill after factoring in these sentiments. This may take some time, he said. There was some convergence of opinion in favour of bringing the prime minister, albeit with safeguards, and lower bureaucracy under the Lokpal's ambit.

However, the lower bureaucracy proposal did not find favour with CPI, with its leader Gurudas Dasgupta demanding a separate mechanism to deal with "crores of such employees". CPM demanded that even the conduct of MPs inside Parlaiment should be brought under the ombudsman's ambit, even though all other parties disagreed on this.

On Lokayukta, there was a collective view that a model Lokayukta bill should be sent to the states, who should be then allowed to make their own respective versions of the Act. BJP argued for CBI's investigative independence and its complete disassociation with the government.

According to Leader of the Opposition in the Rajya Sabha Arun Jaitley, this can be ensured by changing the procedure for appointment of the CBI director.

"If the CBI is controlled by the government," Jaitley said, "it will become a toy because the investigating arm of the Lokpal will be under the government." He added that BJP wants the administrative functions of CBI to be brought under the Lokpal's ambit, which are now vested in the department of personnel and training.


BJP proposed that the CBI director be appointed by a panel comprising the Prime Minister, Lokpal head and Leader of the Opposition. Incidentally, BJP's demand relating to CBI came even as CBI director AP Singh called on the prime minister to say that the agency was willing to accept Lokpal as its new boss, but the latter must be the body with only supervisory power over CBI.

The administrative, financial and legal powers should then be vested with the CBI director, he suggested. Sources say the CBI chief told the PM that any attempts to bifurcate the agency will be damaging.

Singh, in his opening marks at the all-party meeting, said he was keen to see the momentous Lokpal Bill passed during the current session of Parliament based on a consensus that is driven by the House as the "custodian of legislation".

"The government is committed to implement in letter and spirit a good and effective Lokpal Bill that would have a quick and positive impact in further curbing the cancer of corruption without any adverse effects on the efficiency of our system of public administration," he said.
