Maya's changed stance on dailt cooks may irk HC by Swati Mathur

Dropping her hardline stance on appointment of dalits as cooks in primary schools may soften her image for the ‘janta' ahead of the panchayat polls this year, but Mayawati's sudden move could invite the ire of the state high court. Action, however, will depend on whether a government functionary or a dalit will now come forward to challenge the chief minister's latest diktat.

Notably, earlier this year, the UP government approached the high court to defend its April 24 order, which made it mandatory to appoint female cooks from the reserved categories, and who were related to at least one of the children enrolled in the said school. A two-member Bench of the Allahabad high court, on July 19 last, dismissed a PIL filed by Prathamik Vidyalaya Rasoiya Welfare Association challenging this decision and upheld the government order on both counts.

Now, the government has reworked both the clauses; this time agreeing to consider male cooks for appointment, and, importantly, omitting that cooks must be stakeholders in their schools of appointment.

Interestingly, the move, while creating ripples among the state bureaucracy, has also raised concerns over the fate of Rs 15.67 crore, released in the first quarter from the Special Component Plan of the annual state budget. The money, earmarked for being spent only for dalit appointments and honorariums under the mid day meal (MDM) scheme will now remain unutilised or underutilised because of the change in stance. A senior UP MDM official, said: "As per the Centre-state agreement, 75% of the money was given by the Centre. The remaining was spent by the state. We won't need to return the money to the Centre. Whatever is not spent will be carried forward and adjusted against utilisation certificates and a record of the closing balance.''

As per the current budgetary allocation, UP will spend Rs 337 crore towards the implementation of the MDM scheme in 2010-11. The Central funding towards the scheme, for the same period is Rs 1235 crore and includes expenditure incurred in procuring foodgrains, expenditure per child per day, honorarium to cooks, transportation costs, administrative expenses and costs involved in monitoring and evaluating the MDM scheme. Uttar Pradesh has 1,50,799 primary and upper primary schools covered under the mid day meal scheme. Until April 2010, a total of 1,88,699 persons were employed as cooks at these institutions.
