NAC meets today to discuss key policy issues

The Sonia Gandhi-headed National Advisory Council will meet on Friday for the second time this month. It will consider a number of issues, including the Rangarajan panel’s recommendations on the draft Food Security Bill.

The high-profile policy advisory body, headed by the United Progressive Alliance chairperson , may formulate its response to the governmentappointed Rangarajan panel’s recommendations, which were seen as diluting the NAC’s vision of the scope of legally binding food security measures.

NAC typically meets once a month. Two meetings are scheduled for this month as the body could not meet in December due to Sonia Gandhi’s unavailability as the meeting clashed with the Congress plenery.
Friday’s meeting will also discuss the responses from the ministry of tribal affairs and the Planning Commission on NAC’s proposal for the amendment of the Forest Rights Act, 2006. While a response was sought from the ministry of environment and forests, it has asked for time till the end of the month to respond .

ET recently reported that NAC member N C Saxena has criticised the functioning of the tribal affairs ministry in a paper that he has submitted to the council. Saxena also heads a government-appointed panel responsible for monitoring the implementation of the Forest Rights Act.

Another key issue that will come up for the panel’s consideration is the amendments to the Right to Information Act. A working group of the NAC, headed by activist Aruna Roy, had suggested changes to some proposed amendmends to the Act. The department of personnel and training was asked for its response on the NAC group’s suggestions. DoPT’s comments on these will also be discussed at today’s meeting.

NAC’s objections to the proposed rules related to a number of issues, including a proposed word limit and the issue of the status of an appeal in the event of the appellant’s death. One of the proposed rules suggested that one application shall relate “only to one subject and shall be limited to 250 words... ”

Objecting to the proposed rule, the NAC has said, “This would be introducing an exemption which is not in the Act. It is legally wrong for rules to go beyond the Act. The rule about a single subject will be open to arbitrariness and misuse as it is difficult to define.”

The council has also recommended deletion of another proposed rule, which allowed abatement of proceedings before the Information Commission on the death of the appellant, saying such a rule could encourage “murder” of RTI Activists. “This (abatement of proceedings) could encourage murder of RTI Activists . Besides information sought might often be of interest to others apart from the applicant,” it said. The body objected to allowing withdrawal of an appeal during the course of hearing at the Information Commission . It said withdrawal of appeals could become a source of “harassment/blackmail.”
