New norms violate RTE, says panel

Delhi Commission for Protection of Child Rights (DCPCR) on Friday issued noticetothedepartment of education (DoE),Delhi government , over issuing of guidelines for admission in preprimary and class-I saying they violate the provisions of theRighttoF ree andCompulsory Education Act, 2009. in Its notice to the principal secretary , education , the commission has asked the department to re-examine the order . The guidelines were issued by DoEon Wednesday .

The notice says that Delhi governmenthas given itsown interpretations of the RTE Act and made obvious changes that directly contravene the provisionsof theAct.

The commission said while the guidelines of the Union HRD ministry and Delhi Government adhered to the random selection system for the 25% seats reserved for the economically weaker section (EWS ), the selection of rest of the 75% seats is in violation of the provisions of the RTEAct.

According to chairperson of DCPCR, Amod K Kanth , "No guidelines can be issued in contravention of the RTE Act. As per the provisions of the Act, the only criterion is the neighbourhood and random selection . In earlier cases ,thecommission has noticed that schools under the pointsystem give a maximum of 20 point to neighbourhood andin mostcasesit rangedbetween 5 and 10 points . As per theRTEAct,onecannot make any distinction between children , and no parents would likethe pointsystem ."

Since the Act came into effect on April 1, 2010, DCPCR has received over 10,600 complaints of violations of the Act,of which around 9,000 are on denialof admissions .

The commission , took cognizance of the statements made by the education minister , Arvinder Singh . "From his statements , it is clear that multiple criteria have been introduced for schools admissions , and this would create preferences for certain types of categories of children over other categories . This would beclear violation of the provisionsof RTEAct."

DCPCR is the not only one to raiseobjectionstothelatest guidelines . Social jurist , Ashok Agarwal , in a statement , said : "Delhi government's directive of December 12, 2010, on nursery admissions guidelines is simply an order having no legal sanctity and , therefore , has no legal consequences . The order is neither under the provisions of RTE Act, 2009, nor under the Delhi School Education Act, 1973 . Nor it is under any other law . The order does not spell out under which provisions of lawithasbeen issued."

Meanwhile , schools are gearing up for drawing admission policy . While some schools have decided in principle to stick to last year's criteria ,others are yettotake a final call . According to principal of Ahlcon International School , Mayur Vihar , "A final decision is pending . The neighbourhood criterion is our priority , followed by the sibling criterion ."

But a principal of a South Delhi school said : "We will continue with out last year's policy where sibling and alumni criteria will be given maximum weightage ."

Then there are schools which are likely to stick to neighbourhood criterion . "Since a lotof people residing in the neighbourhood work with the Central government and PSUs and their jobs are transferable we will take transfer case as one of the criteria ," said Usha Ram , principalof Laxman Public School .
