Odisha may allow tribals to sell their land to non-tribals -Satyasundar Barik

BHUBANESWAR: The Odisha government is giving final touches to the proposed amendment to the Odisha Scheduled Areas Transfer of Immovable Property Regulations, 1956, which would open a window for tribals to sell their land to non-tribals in the Fifth Schedule areas.

As per the proposal, tribal land will be transferred to tribal or non-tribal buyers through auction. The State government, which has already held four consultations on the issue in Koraput, Kandhamal, Keonjhar and Mayurbhanj districts, will soon make the draft report public.

Government sources said Revenue and Disaster Management department will fix offset prices of tribal lands which are to be placed for auction. The auction will go through three phases during which only members of tribal communities will be allowed to participate. If no participant will reach the level of offset price, the same process will be opened for non-tribal buyers. But final opportunity to buy land will rest with the tribal person if he or she offers highest bid-value without participating in whole process.

Another suggestion has been put forward in consultations that the government should buy tribal lands offering highest land price and subsequently re-distribute among landless tribals.

“We are proposing to facilitate this process on fewer occasions during a year,” said a senior officer.

The Odisha Scheduled Areas Transfer of Immovable Property (by Scheduled Tribes) Regulations, (OSATIP) 1956, was enacted to curb land transfer of tribals to non-tribals. The regulation was amended several times in 1966, 1975, 1997 and 2002 to make it stricter.

However, some tribal groups through State Tribal Advisory Council (TAC) raised demands for permission to sell their land to overcome fund crisis in emergency situation like marriage, studies of wards and critical illness.

Government sources said educated tribals who were working away from their villages also wanted to dispose of their land to non-tribals so that they would get its good value.

Since 2005, there has been consistent efforts by the government to amend 3(I) of OSATIP 1956.

In 2007, an inter-Ministerial Committee was constituted. The IMC’s report, subsequently, got approval of TAC as well as Cabinet.

The Governor approved the report with two conditions that a person from tribal community should be given final opportunity for buying the land even if he or she did not participate in the auction and the highest bid-value offered in auction should be given wide publicity through issue of proclamation inviting tribals and non-tribals to participate in auction.

However, President of India did not give the assent to the amendment in 2010. In 2013, TAC discussed the issue again and decided to constitute an IMC to re-look at the issue.
