The Madras High Court on Wednesday dismissed a public interest litigation petition seeking a direction to the Centre to allot the entire 2000 MW to be generated by the Kudankulam Nuclear Power Project to Tamil Nadu.

In its order, the First Bench comprising the Chief Justice M.Y.Eqbal and Justice T.S.Sivagnanam said the petitioner had not even made any representation to the authorities concerned regarding the matter. It was a policy matter which had to be decided by the government. The court could not issue any direction.

The petitioner, J.Ramesh of Otteri here said to meet the increased demand, Tamil Nadu had to spend a huge sum for buying power from other States. The State's demand was about 15,000 MW; but the total production was 8000 MW. Tamil Nadu was requesting the Centre to sympathetically consider its demand that the entire power be provided to it; but the Union Government was yet to respond.
