Plan to make colonies legal to start all over again -Pragya Kaushika

New Delhi: After many years of political bickering, distribution of provisional certificates and promises by parties to regularise them, 895 unauthorised colonies face another uncertain wait. A legal status for these colonies may be many more years away as the AAP government has decided to redo the whole process from the beginning.

The Urban Development department has mooted a proposal to allow three agencies to redo the boundaries of all the 895 unauthorised colonies slated to be regularised and of a few tagged as ‘regularised'. The proposal has been sent to law department for approval.

These three agencies will then start recharting the boundaries of these colonies in view of the fresh notifications regarding these colonies.

The Delhi government had, in January 2012, sent the boundary plans of all 895 colonies to the municipal corporations for making the layout plans and approving them. Now, the Delhi government has decided to start the process afresh. It is understood that a consensus has been reached within the government for not involving civic body in the process and letting the process gain momentum at the level of divisional commissioners, sources said.

The new agencies will make the boundaries of the unauthorised colonies by using total station machines. Officials said this technique will give exact coordinates needed to finalise the boundaries.

Earlier, it was done through satellite images provided by Geospatial Delhi Ltd. When AAP came to power for 49 days in 2013-14, it started the same process.

Another legal advice the department is seeking is on the year taken into account to fix boundaries. In a pre-poll move, the Centre had taken a decision to regularise all unauthorised colonies that came up between March 2002 and June 2014.

"Much has changed on the ground and we have to make policies according to existing notifications. With the new notification by the Centre, we need to see whether we have to do it for colonies that have come up till 2014, rather than only till 2007," a source said.

Until now, corporations have cleared layout plans for only nine colonies. Even there, there is a legal snag as RWAs have objected to the plans. Of the 895 colonies identified for regularisation, 312 are on private land and have been notified as regularised.

Delhi BJP chief Satish Upadhyay said, "Starting the process afresh will cause inconvenience to the people. The government should define boundaries of only those colonies that have come up since 2007, till June 2014."
