Proposed land bill runs into Antony wall -Subodh Ghildiyal

Top Congress leader and defence minister A K Antony said government should not acquire land for private entities since it is a big trigger for agitations, reverting the debate over land acquisition bill to the strict norms that were sought to be diluted on the pretext of industrialization. 

Antony told the Sharad Pawar-led group of ministers debating the proposed bill that land had become a scarce resource and acquisition was a source of resentment among people. "Then why should the government acquire land for private bodies," he said, counseling caution. 

He recalled that the parliamentary standing committee had also recommended that government keep away from acquiring land for private projects. 

Antony told the ministerial panel on Monday that government should intervene only for private entities that buy 90% of required land on their own. He added that government could acquire land for 'Public Private Partnership' projects after 90% of owners give consent. 

While there was not much reaction to Antony's comments in the meeting, the formula for minimal state role in acquisition for private parties could stem the pressure for dilution of the bill-in-the-works on the ground that it would help industrialization and urbanization. 

While the original draft stated that consent of 80% land owners was must for acquisition, it was reduced to 67% after reservations that such provision would be an obstacle to industry seeking land expeditiously. 

The flagship bill was referred to the Pawar-led panel after serious opposition in the Cabinet meeting. While rural development minister Jairam Ramesh has since argued that core provisions relating to consent of owners, 'social impact assessment' and R&R could not be tampered with since they were part of Congress's election promise, the pressure to make the bill industry-friendly has been visible. 

Antony's view could check dilution beyond the bottom line seen as a must to show it as "pro-farmer". An official said, "From 80% to 67%, Antony's strong pitch can save the equation for farmers which appeared to be slipping away." 

The 90% equation runs close to the land bill finalized in UPA-1 before the Centre buckled under pressure and redrafted the legislation. 

The new draft may acquire teeth if Antony's suggestions are accepted. It has already put SEZ Act in its ambit, implying that acquisition for special enclaves would have to conform to norms relating to rehabilitation and procedures. 

Tribal affairs minister Kishore Chandra Deo has asked the GoM to put coal and mining related laws under the ambit of acquisition act. If accepted, the bill would take care of big chunk of acquisition that takes place in the country.
