RTE deadline: Delhi govt to fine unregistered schools Rs 1 lakh from April-Pallavi Polanki

New Delhi: With the three-year Right to Education (RTE) deadline for unrecognised private schools to register with the government expiring in less than two months, the Delhi government has directed the schools to either apply for recognition by Friday (February 15) or risk penal action. As per the RTE Act, a school that does not have a certificate of recognition will not be allowed to function. After the Act was passed in 2010, unrecognised schools had been granted a three-year extension by the government to upgrade their infrastructure to meet the standards necessary for recognition.

In its latest notice, the government has warned unrecognised schools that after March 31, as per the RTE Act, they will attract legal action which includes, a one-time fine of Rs 1 lakh and an additional Rs 10,000 for every day that they continue to function without recognition.

As per a 2012 Municipal Corporation of Delhi (MCD) survey, there are 1593 unrecognised schools in the Capital which are catering to 1.64 lakh students. (Read reporthere.)

Directing schools to register online and submit land and infrastructure details, the government’s notice states that despite a similar circular being issued in 2011 “many unrecognised school have not furnished the requisite data.”

Meanwhile, managers of unrecognized schools in Delhi have decided to demonstrate at Jantar Mantar on Saturday (February 16) and forward a ‘protest letter’ to Chief Minister Sheila Dixit. “If no action is taken by the government then the managers of unrecognized schools will hold a peaceful demonstration in front Sheila Dikshit’s residence,” said R C Jain, president of an association of private unaided schools – Delhi State Public Schools’ Management Association.

A key demand of the unrecognised schools is relaxation of the land norm, which currently requires schools to have a minimum land space of 800 square metres for recognition as a primary school. The Association is demanding that it be reduced to 160 square metres or 200 square yards, which was the earlier standard.

“We are demanding a relaxation in the land norms for opening of new schools and upgrade of existing schools. We are requesting that the land requirement should be five rooms of 150 square feet each, which was the MCD norm in late the 1990s. That is approximately 160 square metres. We are also demanding that the government should not take action against unrecognised schools, they should be allowed to continue functioning,” said Lakshya Chhabaria, general secretary of the Association.
