RTE: National task force to frame guidelines for differently-abled

Union Human Resource Development Minister Kapil Sibal on Tuesday said that a national-level task force would be set up to frame guidelines to protect the interest of severely disabled children.
Disability activists had last week raised objections to a clause in the Right to Education Act that gives the option of home-based schooling for children with severe disabilities. In a meeting with activists on Tuesday, Sibal assured that all possible efforts would be made to ensure safeguards are in place.

“The minister has assured that a task force with representatives of all stakeholders as members will be formed soon and it will issue guidelines to ensure that severely disabled children are not purposefully kept away from mainstream schooling. The minister’s assurance is a great relief,” said Dr Mithu Alur, the founder chairperson of Spastics Society of India.

Poonam Natarajan, the chairperson of National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities, said, “The minister has committed that guidelines would be very stringent and serve the purpose. Many activists attended the meeting. They felt that it was always better to have a range of options available for disabled children. We hope the task force will be able to work towards ensuring that our concerns are addressed.”

Aarth-Astha’s founder director Radhika Alkazi, however, expressed disappointment over the clause being retained in the Bill.

An amendment to Section 3 of the Right to Education Act, which was passed by the Rajya Sabha on April 24, suggests that a child with multiple and severe disabilities like autism, cerebral palsy, mental retardation “may also have the right to opt for home-based education”. The provision was added to the Act on the recommendation of the Parliamentary Standing Committee. Activists termed this a regressive move, and a violation of human rights, meant to condemn a disabled child to imprisonment at home. They had written to Prime Minister Manmohan Singh and UPA president Sonia Gandhi, besides Sibal demanding that this clause be deleted altogether from the Bill.
