Sedition: HC grants cartoonist bail

The Bombay High Court on Tuesday granted interim bail to cartoonist Aseem Trivedi (25), charged with sedition and sections of the Information Technology Act, 2000 and the Prevention of Insults to National Honour Act, 1971, and ordered his release from the Arthur Road jail here on a personal bond of Rs 5,000.

The direction came after a PIL filed by city-based lawyer Sanskar Marathe on Tuesday urged the court to quash the charge of sedition under section 124 of the Indian Penal Code, to declare Trivedi’s arrest and detention as illegal, and release him from jail immediately.

A complaint was filed by Amit Katarnavre, a law student from Navi Mumbai, at the BKC police station on January 30. Trivedi, who hails from Kanpur, surrendered at the BKC police station on September 8.

Granting interim bail to Trivedi, Chief Justice Mohit Shah and Justice N M Jamdar adjourned the case for further hearing on September 17.

Later, India Against Corruption member Preeti Sharma Menon said, “Respecting the HC’s order and the Home Minister’s assurance of removing the sedition case, Aseem will sign the bond and come out at 3 pm on Wednesday.”

Arvind Kejriwal, who visited Trivedi, on Tuesday demanded that all the charges against Trivedi be dropped or else he will sit on protest outside the Arthur Road prison here from Saturday.

Home Minister R R Patil said that the Mumbai Commissioner of Police had been asked to check if Trivedi had insulted national symbols and if the sedition charges against him were retainable. He said the government would take a decision regarding modifying the charges after the CP submits his report.

“After the probe is completed, we will decide whether to withdraw the case or not. Senior officers are investigating the matter,” said Patil after a meeting with home department officials. He added that the law and judiciary department would be consulted if necessary.

Chief Minister Prithviraj Chavan said that the Home Ministry was checking if the sedition charges against Trivedi need to be dropped.

With public pressure mounting, Patil said: “The government does not want to be unjust towards anyone. There is no pressure on the government and neither have the police pressured Trivedi to seek bail.”

He said that members of IAC do not need to protest in this regard and the government would take appropriate action.
