“Its members should not be from the government”

With the impasse between the civil society and the government on the structure of the Lokpal Bill continuing, the former Chief Election Commissioner, T.N. Seshan, announced his version of the Bill on Friday, which provides for establishing an anti-graft body similar to the Election Commission.

“The issue of corruption is important to the nation and this is an accepted view on all sides,” he read aloud the first point of his proposal. The 22-point proposal to establish an anti-graft body took four months to prepare, he said. While maintaining the supremacy of the Constitution and Parliament, the anti-graft body would be similar to the Election Commission.

“It is similar to what has been proposed by Congress general secretary Rahul Gandhi, but I assure you I have never spoken to him,” he said.

This version of the Bill, which was sent to spiritual guru Sri Sri Ravishankar a few days ago, should be the basis of discussions between the government and Team Anna. “This version can be debated in Parliament itself without having to go to a Standing Committee,” he said.

Mr. Seshan's version proposes that the majority of the members in the anti-graft body should not be from the government and as a safeguard selection should not be by vote but by unanimous choice. However, he stressed that the Lokpal and Lokayukta should have enough autonomy. “This can be secured only by a constitutional amendment.” He also supported the view that the lower bureaucracy should fall under the ambit of the Lokpal.

He said it was possible to meet the August 31 deadline set out by Team Anna. “A week or 10 days is a reasonable deadline to deliberate on a bill like this,” he said
