Singur ordinance not to be notified by Indrani Dutta

A day after it announced issuing an ordinance to reclaim disputed land at Singur, the Mamata Banerjee government on Friday said it would not notify the ordinance, but would instead place it as a Bill in the ensuing Assembly session. The session, which was earlier slated to commence from June 24, will now start on June 13.

Ms. Banerjee told reporters at the Secretariat: “The Ordinance is not being brought into force.” She said the Bill (which she named as the Singur Bill) would be moved after the Governor's address. “This would be a new session of the House and it would be the budget session, but for now no new Bills would be placed barring the ‘Singur Bill,' Ms. Banerjee said.

Giving the rationale behind the change of mind, Ms. Banerjee said even if she had notified the ordinance, her government would have had to introduce a Bill within six months.

“This would have led to loss of time. We did not want this. Singur is important to us and the Singur people are coming to us every day, they are suffering badly – so we decided to introduce a Bill without any loss of time,” she said. She said the fact that a session was being held within a month of the declaration of the results was a “big thing.”

On the very day of assuming office, Ms. Banerjee announced after her first Cabinet meeting that it was decided to return the land of ‘unwilling' farmers at the Tata Motors site at Singur. She said she had asked for the agreement entered into with the Tatas by the previous government.

Industry Minister Partha Chatterjee said he would release the agreement to the press very soon. However, later, there was backtracking by the government with Mr. Chatterjee indicating that legal issues may be involved in this.

Ms. Banerjee's announcement came after the Left said that it was unconstitutional to introduce an ordinance when the Assembly was in session. After the election of the Speaker last month, the session was adjourned and not prorogued. Leader of the Opposition Surya Kanta Mishra also met Governor M.K. Narayanan on Friday to protest against this issue.

Adding another dimension to the confusion, the former Assembly Speaker, Hasim Abdul Halim, told The Hindu that it was “undemocratic” to suddenly advance the Assembly session. It should have been preceded by an all-party meeting where consensus was arrived at on the date of it being convened.

“Members may have other engagements,” said Mr. Halim.

On the Bill Ms. Banerjee proposes to move in the House during this session, he pointed out that a Bill could not be introduced in an abrupt fashion.“It can neither be done on June 13 or June 14 as the first day would be marked by the Governor's address and the Tanks giving motion. On the next day [June 14] there has to be an obituary reference as a sitting member has died. It can only be done after these matters are attended to, as per rules,” he said.
