Tahsildar fined for delay in RTI reply

MANGALORE: Mangalore tahsildar Ravichandra Naik will have to cough up Rs 5,000 as penalty for not providing information on time to an applicant under the RTI Act. Karnataka Information Commission penalized Ravichandra for failing to provide information under the Act to applicant B Prakash Bhat, who had sought information related to Bantwal taluk office, where at the time of the complaint Naik was the tahsildar.

Prakash filed an RTI application in May 2011. The respondent had issued an endorsement to the petitioner stating that the information related to cataloguing and indexing of his office records is under progress and it is being prepared as per the circular issued by the revenue department. After completing the same, the information will be provided to the petitioner.

Following this, Prakash filed a complaint before the Commission in September 2011. He stated in the complaint that the district administration had given an undertaking before the Commission that all tahsildars have undertaken the task of cataloguing and indexing of records of their offices. Further, he requested the Commission to direct the respondent to provide information free of cost and impose penalty on him.

After hearing both parties, the commission served a show-cause notice to the respondent. State information commissioner MR Poojar found the explanation given by the respondent in his reply to the show-cause notice unacceptable and decided to impose a penalty.

Accordingly, Naik will have to pay the penalty from his February month's salary to the government treasury. The Commission also asked the respondent to submit a report enclosing the chalan receipt of penalty payment.
