Tribals' ministry complains to Ramesh about over-reach

Tribal affairs minister Kanti Lal Bhuria has written to environment and forests minister Jairam Ramesh that the committee the latter set up under National Advisory Council member, N C Saxena, is going beyond its purview to tell how the Forest Rights Act should be implemented. He has demanded that the committee should stick to looking at the role of the forest department in view of the Act.

The letter, setting off a turf war between the two ministries that have always been at loggerheads on the creation and implementation of the FRA, says, "The committee during its visits to states, is not expected to suggest how the Act is to be implemented. Nor is it expected to make references to the (tribal affairs) ministry as to the instructions that the ministry should communicate to the state government regarding the implementation of the FRA."

The creation of the committee too was mired in controversy. The environment minister had set up the committee to review the implementation of the FRA and stacked it with forest officials despite the largely held view that the forest department had at various levels impeded its creation and implementation. The key tribal group, Campaign for Survival and Dignity, had protested claiming it was like setting the accused to police themselves.

Reacting to the criticism and proposed committee members withdrawing themselves, Ramesh altered the composition of the committee bringing on board N C Saxena as co-chair with a forest officer.

In his letter, Bhuria has pointed out that the committee is only meant to `study' the situation. He says, "Indeed we believe that the main reason why the committee has been constituted is to reorient the functioning of the forest departments as well as its laws in context of the new thinking and spirit behind the Forest Rights Act."

The letter notes, "The committee would be missing the forest for the trees, as the saying goes, if they fail to understand that the study of FRA is for recommending policy changes in the future management of forestry sector, identify the role of forest officials and other agencies for conservation and management of forests...and define a new role for the forest department vis-a-vis gram sabha..."
