UP polls ahead, govt clears 4.5% minority quota within OBC 27%

The government today decided to create a 4.5 per cent sub-quota for backward minorities within the 27 per cent quota for Other Backward Classes (OBCs) in jobs and admission to educational institutions.
 
The political significance of the move lies in its timing just ahead of elections in Uttar Pradesh. The sub-quota was one of the Congress’s 2009 poll promises, but it appears in the current context to be targeted primarily at the sizeable heartland Muslim votebank, and particularly at the over two dozen caste groups recognised as backward Muslims in the state.

According to some estimates, Muslim votes could tilt the scales at over 100 assembly seats in UP. Muslim votes played a key role in the Congress’s impressive performance in 2009 in the state. As many as 21 of the 90 minority-concentration districts identified by the government for special attention are in UP.

The sub-quota, cleared by the cabinet tonight, will be notified by an executive order effective January 1, 2012. It will be applicable to all minorities included in the central list of OBCs, sources said.

The minority affairs ministry had initially proposed a 8.4 per cent sub-quota, including 6 per cent for Muslims, on the lines of the recommendations of the National Commission for Religious and Linguistic Minorities. It was, however, cut to 4.5 per cent based on the Mandal commission formula.

Nine states have already introduced the sub-quota. The demand for reservation grew louder after the Justice Sachar committee report established Muslim backwardness.

While the constitution does not permit religious quotas, the government is banking on the 1990 Supreme Court judgment in the Indira Sawhney case, where the court had said that there was “no constitutional or legal bar” to a state categorizing “backward classes as backward and more backward”.
